DMCA Policy for all-byte.com

All-byte.com respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe that your work has been copied in a way that constitutes copyright infringement, please follow the procedure outlined below to submit a DMCA notice.

Filing a DMCA Notice

If you believe that content on all-byte.com infringes your copyright, you may submit a notice of infringement by providing the following information to our designated DMCA Agent at contact@all-byte.com:

  1. Identification of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the material that you claim is infringing or is the subject of infringing activity and that is to be removed or access to which is to be disabled, including information reasonably sufficient to permit us to locate the material (such as the URL).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

Counter-Notification Procedure

If you believe that your content that was removed (or to which access was disabled) is not infringing, or if you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law to use the material in your content, you may send a counter-notification containing the following information to the DMCA Agent:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district, or if you are outside the United States, the jurisdiction of any judicial district in which all-byte.com may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.
  4. Your physical or electronic signature.

Repeat Infringers

All-byte.com reserves the right to terminate user accounts or access for users who are found to be repeat infringers.

Any misrepresentations in a DMCA notice or counter-notification may expose you to liability for damages (including costs and attorneys’ fees). It is advisable to seek legal counsel before filing a DMCA notice or counter-notification.
